We are in deep shite with Wordpress again *groan* wonder who it is complaining this time....

UPDATE- Not sure why the blog was closed down but it was reopened without ANY response to me so WHAT?!
To everyone that wonders why we put up with it- Wordpress is way more user friendly and the IP listing for each comment has busted more than one reseller pretending to be someone else....or a husband *snort*

She should know better I think? I just feel like buyers might believe she actually made the ring herself. If she plated or added patina to it herself then I didn’t see it anywhere in her description.

ECO really enjoys using Wordpress but they can be so infuriating sometimes. They removed this post from the blog and now need to contact me before I can post again. Imagine my surprise when my google alert let me know I was featured on your blog today. Normally I am thrilled to get a feature, but in this case I was mortified. I am asking you to remove this post about me. Here is why:

When I started selling the line of jewelry using Legos, I did hours of research to try to avoid violating Lego’s copyright. I did not use Lego in the title because of this (not to avoid Google crawls as you suggested). I was trying to respect the brand. I also followed Lego’s requirements (as found on their site) by adding the ® every time I mention the brand name in my description. I changed my wording because Lego requires that you not call them “legos” but “lego bricks” instead. I also added Lego’s own legal disclaimer (which they also require). Lastly, on the advice of a friend who works for a copyright attorney, I wrote to Lego’s legal department and told them about my line. As of today, I have not heard back from them.

As you can see, I really have done due diligence and it was not my intent to violate copyright. I think it would be appropriate for you to remove me from your site before my hard-earned reputation is further damaged.

Frankly I like the Lego jewelry. I find this a lot better than sweatshop item resellers. I also think it’s a lot better than slapping yet another Twilight image on something and selling it as a unique, original piece of jewelry.

People are buying your ring because if it’s association with the lego brand, not necessarily your craftsmanship, I believe you are imposing on the Lego company’s copyright, “they haven’t gotten back to me” isn’t going to hold up in court.

Lego only allows non-comercial use. I recall a few years ago someone on Etsy was forced to remove all their Lego (R) jewelry. Rubygirl must have read the info in this link, but missed the repeated notations that it is for “non-commercial” use. I am sure you would have to acquire and pay for rights when selling Lego (R) or any other trademaked, as well as pay a royalty fee.

Lego (R) is as aggressive with trademark/copyright offenders as Disney. And Nina, the blog master of this site can use the photograph under the Fair Use Agreement because she linked to the original photograph. Even though the seller has a copyright listed on her page, she is copyrighting something that infringes on someone else’s copyright, so it would never hold water in court, just as a disclaimer would never hold water in court. I don’t think Lego (R) could be more clear on their terms as being for non-commercial use.

There’s a big difference between non-commercial and commercial use. The link I provided (which appears to be the information you are citing) refers to non-commercial use only. No where is commercial use mentioned.

Apparently lack of any factual information doesn’t stop the owner(s) of this site in freely engaging in anonymous character assassination. I would imagine Lego can’t find every single violator and must rely, in part, on reports brought to their attention.

Lego sells it’s products for NON-COMMERCIAL use. Read the trademark and copyright laws CAREFULLY.

I do remember an Etsy seller who received a C&D letter, and a request for royalties.

Rubygirl is hand casting Lego’s and using their logo. How the hell is that not trademark infringement?

But then again, Sanro has requested no “Hello Kitty” be sold and Etsy had sellers remove them, yet the place is still flooded with Hello Kitty. Because ignorance is bliss for some.

Also, I’m assuming that all she’d have to do is take the word “lego” off of her items and she could still make building block rings etc. You can buy building blocks that are a generic brand and I know of at least 1 seller on etsy who sells building block soap (it doesn’t say lego).

So, wouldn’t her items be legal if she took the lego name off of them and stopped sending them with real Lego bricks?

Of course, that would probably decrease her sales.

Using Lego blocks as a component in something is one thing, this seller is MAKING new Lego blocks with the word Lego right on them! She is using a Lego piece as a mold, and casting MORE Lego pieces in silver. What she is doing is copyright infringement. Yes, the pieces are adorable. But that doesn’t make it ok to sell them. OF COURSE Lego will not allow this. Saying that somehow this is ok because she hasn’t heard back from Lego is ridiculous.

To the maker of the Lego rings:

They are very cute! Clever idea.

You should keep making them – but please, for your own sake – take the brand name “Lego” off the rings. This is primarily a TRADEMARK INFRINGEMENT matter.

A trademark’s main purpose is to allow a customer to know where the goods they are buying originate from. By your unauthorized use of “Lego” on the rings, you are in effect saying ‘these rings are made by Lego’. Which, of course, they weren’t.

Just because you haven’t heard back from Lego doesn’t mean a thing. Legal departments are very busy. Who knows if the right people even got your letter?

Trust me – they CAN ask you to desist. Worse, they can also request damages! (As in – money you owe them for inappropriately making money off their trademark.)

I don’t think you understand intellectual property law. It’s really complicated. Trust me – I worked as a trademark manager for many years. And sent many a cease and desist letter and requests for damages for far less blatant trademark infringement than yours.

Don’t get mad about this callout. It’s bringing views to your items (and possibly sales), and it may very well save you legal costs!

Oh – PS. Copyright, trademark and patent are all different. (I don’t know much about patent or copyright law.)

The name “Lego” is the trademark. As long as Lego is using it – they enjoy monopoly rights forever. (As in – YOU can’t put it on your goods.)

The click together bricks design WAS patented. But patents generally only last 20 years. Their design patent expired in 88. So I THINK you can use it. Especially since you’re using it for jewelry.

They did try to stop another toy maker from making similar bricks. Since the patent was expired, they tried to make a supreme court said “”Trademark law should not be used to perpetuate monopoly rights enjoyed under now-expired patents.” and held that Mega Bloks can continue to manufacture their bricks.

Intellectual property law is, like I said, confusing as hell. I don’t even begin to understand patent law.

So, you can see, you really don’t want to tangle with their lawyers.

Did go to the TM office’s website to get the correct address of their US TM lawyers? I found these guys listed, is that who you wrote to?

If a seller crafts with pop culture references (celebs, toys, media characters for examples), there are issues of legality.

Sellers use these references because the name or image recognition gives their work visiblity. They are exploiting the work and expense the entity who owns the rights has put into the brand. Do sellers really think corporations will react like Etsy does and say “your work is cute, so go ahead and rip off, little girl”?

You’re the one hand-casting the silver blocks, not them… so while you’re commiting a trademark infringement, you’re also giving them credit for something you’re making.
Give yourself the credit, and take their name off your pieces!

WTFSIAPDF I wrote to Lego’s legal department Saturday and just received a response. If I recall correctly, Rubygirl said she wrote to them and never heard back.

The response I got back thanked me for reporting it to the company. I was told that they take their trademark very serious and are “looking deeper” into Rubygirl’s Etsy shop.

There was a phone number included in case I could offer more information. They got back to me very quickly and I take it from the reply, they don’t fool around.

The issue with calling out, with links and documentation is that it connects us with a wider world than just the Etsy community. Some of the callouts involve more violations than just the Etsy TOU. Like the issue with Lego.

I think the difference with Rubygirl is that she is copying their trademarked name on her own work, while the others are making jewelry and things like that from actual Lego’s. What Rubygirl is doing is probably considered much more serious because of that.

I was pleased to get an actual personal message and not a generated reply. It was very clear that they are going to investigate Rubygirl’s shop. I was provided with phone numbers to call if I could provide more information and an email address where I could send any other information I might have.

They were very grateful that I contacted them and made them aware of this.

What I find odd is that she said she contacted them and never heard back. I heard back in less than two days.

What WTF said – you can use whatever materials you want to make something and sell it. This particular ring is branded lego – as if lego made it. That’s infringement. The whole point of trademarks is so that consumers can distinguish the origin of the things they buy.

Since the previous thread was deleted – WTF – not sure who you wrote to. I got this as the address of Lego’s US legal representation for their trademarks. These people should know the deal:

A very amusing email I received from the crazy funkyshique bunch…

I just finished reading your blog entry on Funkyshique. It was incredibly shocking to me as an Etsy seller myself to see how other sellers would treat Funkyshique.
Etsy is a plethora of mixed items, including items to be altered, things that appeal to the artistic mind. You would have to report over half of Etsy and could spend 24 hours a day pointing out non-vintage and non-handmade items.
Funkyshique has a nice subtle style and doesn’t exploit any type of manufactured item, unlike many of the made in China supplies found on Etsy. She is a hard working Mother, American Citizen and Hobbyist with her own unique style and has respect enough for our planet to recycle.

Does every knitter weave their own yarn or every artist mesh there own canvas fibers? I hope she paints the figurine purple and sprinkles it with glitter and calls it Altered Art.
What a shame that your blog exists simply to insult others. I see nothing but jealousy and envy and negativity.

"I am grossed out by all the baby items containing Swarovski crystals, especially the pacifiers. Anyone who has ever been around a baby knows they put EVERYTHING in their mouth, and you are going to give them a Swarovski pacifier? the shops do not have anything in their policies regarding lead in crystals..."

I have all the sympathy in the world for people who have hardships. Lord knows I have had enough of my own. But the one thing I would never do is screw over my customers and then whine about how it's all about me and I'm a good person. If I had any outstanding business issues when tragedy struck, I would be hightailing it down to the nearest Kinko's to use a computer within a couple of hours. If someone on another blog was saying this about you then you would 
expect us to do something about it.

Freedom of speech does not come into this. The law does. We have to 
obey the law and so does everyone else. The person being attacked has 
every right to engage a solicitor and start proceedings.

If this is a random reader and they are making serious allegations 
then why not delete them?

Hi! i've been flagging this shop for 3 weeks straight and have even emailed them about it. All I get is a generic hi there! This shop is selling puppets from the company Folkmanis. they have even taken the pictures right out of the website. The finger puppets are Peruvian imports. The whole shop is a sham, including the story about the grandma making them for over 50 years.

Thats funny, Folkmanis has been in business for 30 years maybe they stole this lady's patterns! ;) Shame on you Folkmanis.

I didn’t think you could grab something a few years old at a yard sale or thrift shop, sell it with something else unrelated that may or may not be 20+ years old (can’t tell from the photos), and list the marriage as ‘vintage’? There’s no assemby of the items, it’s just collected unrelated stuff.

But then the Etsy staff doesn’t know any better. The staff continues to ignore so many items that are handmade and look kinda cool, or are really vintage, to promote copyrighted items and yard sale castoff stuff.

Oh, and the few people I know who have been into the real equestrian thing would gag at Etsy’s idea of ‘equestrian style’. I think Etsy is confusing costumes for comedy rodeo acts, or what people who just collect items related to a specific animal (the horse, in this case) buy, with ‘equestrian’. Doesn’t matter so much now. Read an article on MSN about fall fashion trends last week, and it said the equestrian thing is ovah.

How can these be vintage when Etienne Aigner only made umbrella's, perfume and other small accessories until 2000 and didn't start making leather goods until 2001?

This shop has a few other things that are made by brands not even in existence 20 years ago.

And these DKNY boots in <a href="http://www.etsy.com/shop.php?user_id=5189874">nstylevintage</a> are probably not vintage since DKNY wasn't formed until 1989 and the shoes and boots weren't introduced until a couple years later. The lace up boots weren't popular until the late 1990s so I doubt these meet the 20 year test.

I sent two e-mails along with flags reporting two sellers who are selling mass produced jewelry from Korea/China. I provided links to their Etsy listings along with links to other big box foreign jewelry websites carrying the exact same merchandise, but the shops are still there and their items not removed. This is a genuine concern of mine, as I am a handmade jewelry seller and there is already enough competition amongst handmade sellers themselves. I feel that their presence on Etsy completely devalues
'handmade' and wondering why they are still selling despite the multiple flags sent along with proof that their items are not handmade. Thanks in advance for taking the time to address this.

first, let me say that your blog is quite amusing and informative. thanks for keeping us all in the know!

secondly, i want to bring your attention to a few shops - of many - which are international sellers peddling tourist souvenirs as 'handmade'. as a seller in Asia with only (verifiable! :) vintage items they're not really my personal competition, but it does hurt my shop when people believe that everything sold from Asia is a fraud.

these two shops sell the EXACT same rubbish that i see in every tourist-trap bazaar, every day. sure, it's 'handmade' somewhere along the way - but in sweatshops by women and kids who then sell it to these people for mere pennies. i don't think that's the sort of image Etsy wants to portray.....

About 10 of us have been watching the voting pattern all week- it is amazing how, when flapperdoodle moves ahead by 10 or more votes, Penelope manages to close the gap.
While I think she makes her necklaces, some of her bracelets are mass produced.

ALL beads and findings which are available here in German stores are imported from Asia or from somewhere else in the world. These sellers use to tag their beads ‘German vintage’ just for making ‘precious’ beads out of them (even out of worthless plastic beads!) and sell them for expensive prices.
Due to this ‘vintage fashion style’ hype in the USA many people are making lots of profit on that with such false products. There actually has arisen a real ‘German Vintage bead’ mass distribution in USA. (You can see that if you search for ‘German Vintage Beads’ on the internet. Just try out by yourself! You’ll find US-sellers only, no German at all… even no Asian sellers, who distribute such false ‘vintage beads’!)”

This is just one of the blatant resellers from China on Etsy. They change their profiles continuously, changing what they say about their business. It almost appears that Etsy is feeding them the terminology and profile that would keep them in line with the TOU.

Please address these blatant cases. The sellers and buyers on ETsy all know about them, and are disgusted.

Evidently Etsy closed their shop once, and somehow they were able to manipulate their language to get it reopened. Any time a shop has many different style items requiring differing expertise & machines, and totally professional-shot photography in the asian style (YET BLURRY ADDS ETSY CALL OUT), one gets suspicious. I am not alone -- many sellers know this, and are very frustrated with Etsy in regard to these.

Hello, Here is an etsy reseller.....she has been doing it for a bit, earlier she had a few products but now she has just added a couple of pages......she is even not using her pictures and everything is from the place she is buying these bags. She only has the colors that the wholesale place is selling and there are a few wholesale shop links I have at the bottom that are selling these products.

I have mentioned the product name as she has in her shop and then I have the etsy link and along with the link from the wholesale site. She is selling at 2-3 times the price on etsy. I just can not understand how can people do this or am I just too dumb

I am extremely skeptical of this seller’s jewelry section. Her profile states that all of her items are “hand sewn” and it mentions nothing about working with jewelry, metals, glass, etc. Her materials listed are generally along the lines of “pendent, chain”… Last I checked putting a pendant onto a chain didn’t count as “making” something.

They bash eBay and claim superiority over us... they lock threads and suspend posting abilities too... Ive never been so insulted in all my days by such an inferior group of tards and misfits..

Can you see I am a little peeved off LOL.... I contacted their support and complained and probably to no avail anyhow.. who gives a F.. I dont.. They can go to h e double hockey sticks for all I care....

I flagged this seller the day they listed their first item two weeks ago. They have made 41 sales in two weeks with their mass produced crap listed in the handmade categories.

Almost everything is listed in the handmade Everything Else category, and on their very earliest listings under Materials they have put in “not made by me”. One item, a plush keychain (which clearly shows the commercial price tag) is under Dolls and Miniatures. I guess most of the stuff could go under Supplies, Commercial although the plush keychain shouldn’t be on Etsy at all.

This pisses me off. It could have been nipped in the bud if the flagging system actually worked.

$47 A Month for Etsy Secrets..

Look at this super cheesy web layout for "<a href="http://etsysecrets.com/">Etsy Secrets</a>". You think you would want to class it up a little bit so it didn't look so sham wow-y.

Ran by <a href="http://www.etsy.com/shop.php?user_id=5074716">TimothyAdamDesigns</a> he is sending people "quick! reserve your spot" VIP emails to join in the $47 a month "secret club".

One month the secrets are blogging, the next tweeting, etc. basically all "duh" information. His shop has 1300 sales, nothing to balk at yet not sure if that warrants $47/ monthly for his shop wisdom. It hasn't gotten him THAT far.

He at least conned one person, read about it <a href="http://www.etsy.com/forums_thread.php?thread_id=6152138&page=1">here</a>.

A reader recommended reading her <a href="http://www.etsy.com/feedback_public.php?user_id=5247852">feedback</a> for a recent gem, it seems on top of everything else she is now hoarding cash. Stay classy!

The only positive in this whole experience is that the vendor told me on 4/6 to keep the earrings that were sent incorretly (as a gift)and are sold for $9.99 at her Estsy store.I have made 49 purchase through Etsy in the last 3 months and all other experiences have been totally pleasant and positive experiences.</blockquote>

"I am not exactly sure what I am going to do yet, whether I am just going to wait to get what I have ordered and then delete my account, or if I am going to stay on and buy. Either way, my buying on Etsy will probably be drastically reduced anyway as I made a lot of my buys in the forum, so I don't see that it matters much one way or the other. I will talk to my husband and see what he thinks and then decide. It is not like it is any life altering event in my life or anything, but I have to weigh the pros and cons of it all."

She must have a really trouble free life to have to discuss with a spouse the pros and cons of buying at a site that won't let her shoot her mouth off.
